#1. Client & Third Party Information
  1. ZION PUBLICATIONS will not distribute or supply any third party with CLIENT information, unless given written consent by the CLIENT.

  2. ZION PUBLICATIONS will not reveal any information and/or contact details regarding third parties who work with ZION PUBLICATIONS, this would include printers, manufacturers, hosting companies, etc.
#2. Exclusive Rights
  1. ZION PUBLICATIONS reserves the right to display sample copies of CLIENT designs, publications, photos and websites to potential customers, by display on the ZION PUBLICATIONS website, business portfolio, promotional items or as required by ZION PUBLICATIONS.
     
  2. ZION PUBLICATIONS reserves the right to the original versions of designs, publications and websites. CLIENTS may not obtain any original versions of designs, publications and websites whatsoever. All designs, publications and websites completed by ZION PUBLICATIONS, become the sole property of ZION PUBLICATIONS.
    The CLIENT only pays for the usage of the design/website, not the ownership of it. If the CLIENT wishes to have exclusive rights over the design/website, a 'Buyout’ fee will apply.
    ZION PUBLICATIONS has sole ownership over all their designs/websites, and therefore, transferring of websites to other web hosting accounts will not be permitted unless the new web hosting accounts are registered by ZION PUBLICATIONS.

  3. ZION PUBLICATIONS reserves the right to use similar concepts from a CLIENT'S design for another CLIENT'S design.
     
  4. ZION PUBLICATIONS reserves the right to display their name and contact details on the cover and/or content pages of all written and digital publications, such as novels, books, magazines, booklets, etc, produced by ZION PUBLICATIONS. These details will not and should not be removed whatsoever.
     
  5. ZION PUBLICATIONS reserves the right to all web hosting and domain registration information, which was registered by ZION PUBLICATIONS. The CLIENT may not obtain this information. These accounts are registered through ZION PUBLICATIONS and shall stay as the sole property of ZION PUBLICATIONS.
     
  6. ZION PUBLICATIONS reserves the right to display their name and link to the ZION PUBLICATIONS website on all websites created, designed and/or constructed by ZION PUBLICATIONS. This applies to all websites, whether they are newly created or are modifications to the original existing website design. This also applies to websites whereby ZION PUBLICATIONS has only designed the overall look, concept & layout. These details will not and should not be removed whatsoever.
     
  7. ZION PUBLICATIONS reserves the right to withhold all designs, photos, publications, websites, and prints, if the CLIENT has not paid the full balance on the invoice and/or statement by the deadline date.

  8. ZION PUBLICATIONS reserves the right to use the same design, website, photograph or publication from a previous CLIENT, if the design has been cancelled or the CLIENT has not paid the full fee within the required time-frame.
#3. Copyright & Issued Rights
  1. Copyright to the design of other items such as logos, photographs or literature supplied by the CLIENT will remain with the owner of those items, i.e. the designer or the CLIENT.
     
  2. ZION PUBLICATIONS designs and/or publications may not be copied, photocopied, reproduced or transmitted without prior consent from ZION PUBLICATIONS.
     
  3. ZION PUBLICATIONS retains full copyright of all their designs, publications, photos and websites, and they may not be altered by the CLIENT, or third party. Copyright specifications as follows:
     
    1. Edited/Reconfigured images
      >> sketch, collage or previous design provided by the CLIENT for ZION PUBLICATIONS to digitally reconfigure or redesign.
      ZION PUBLICATIONS will maintain copyright ownership of the reconfigured or redesigned images, and the CLIENT will maintain copyright over the original sketch, collage and/or previous design.

    2. Email Branding
      ZION PUBLICATIONS owns copyright over the layout design, other design elements, and edited/reconfigured images, provided that ZION PUBLICATIONS completed the designs. The CLIENT will maintain copyright over their original photographs/images, provided that ZION PUBLICATIONS does not currently own copyright over them, or any third party.

    3. Email Newsletters
      ZION PUBLICATIONS owns copyright over the layout design, other design elements, and edited/reconfigured images, provided that ZION PUBLICATIONS completed the designs. The CLIENT will maintain copyright over their original photographs/images, provided that ZION PUBLICATIONS does not currently own copyright over them, or any third party.

    4. Event Designs
      The respective company who created the layout design and other design elements will hold full copyright over them. The CLIENT will maintain copyright over their written material and original photographs/images.

    5. Graphic Design, 3D Models, Caricatures & All Other Designs
      ZION PUBLICATIONS owns copyright over all designs and edited edited/reconfigured images, provided that ZION PUBLICATIONS completed the artwork. These designs may not be altered by the CLIENT, or third party. The CLIENT will maintain copyright over their written material and original images/photographs, provided that ZION PUBLICATIONS does not currently own copyright over them, or any third party.

    6. Photographs
      ZION PUBLICATIONS owns copyright over all photographs, provided that ZION PUBLICATIONS produced the photographs.
      The CLIENT, or any third party, may alter these photographs however they wish. ZION PUBLICATIONS will not maintain copyright over the modified photographs, nor take any responsibility or claim on those modifications to the photographs. Modifications are done at the client's sole discretion.

    7. Signage
      ZION PUBLICATIONS owns copyright over all signage designs and edited edited/reconfigured images, provided that ZION PUBLICATIONS completed the artwork. The CLIENT will maintain copyright over their written material and original images/photographs, provided that ZION PUBLICATIONS does not currently own copyright over them, or any third party.

    8. Website Design
      ZION PUBLICATIONS owns copyright over the layout design, website coding, illustrated navigational bars, other designs, and edited/reconfigured images, provided that ZION PUBLICATIONS completed the designs and coding. The CLIENT will maintain copyright over their written material and original photographs/images, provided that ZION PUBLICATIONS does not currently own copyright over them, or any third party. ZION PUBLICATIONS reserves the right to display their name on the website, with a link to the ZION PUBLICATIONS website. These details will not and should not be removed whatsoever.
      Standard websites may not be altered or changed, whatsoever, by the client or any other third party. Modifications to these websites may only be done by ZION PUBLICATIONS.
      Websites that run from a database may have certain contents on their website changed/modified by the CLIENT through the Admin Panel on the website. ZION PUBLICATIONS will not be held responsibile for these changes/modifications. Other changes to the website, other than through the Admin Panel, are not allowed to be made by the CLIENT or third party.
      ZION PUBLICATIONS has sole ownership over all their designs/websites, and therefore, transferring of websites to other web hosting accounts will not be permitted unless the new web hosting accounts are registered by ZION PUBLICATIONS.

    9. Written & Digital Publications
      >> novels, magazines, manuals, booklets, books, etc.
      ZION PUBLICATIONS owns copyright of the cover and layout design, other designs, as well as edited/reconfigured images, provided that ZION PUBLICATIONS completed the artwork. The CLIENT will maintain copyright over their written material and original photographs/images, provided that ZION PUBLICATIONS does not currently own copyright over them, or any third party. ZION PUBLICATIONS also reserves the right to display their name, logo and contact details on the written publication, on the cover and content pages. These details will not and should not be removed whatsoever.
#5. Liability
  1. Photographs
    While ZION PUBLICATIONS retains full copyright of all their photographs, the CLIENT, or any third party, may alter these photographs however they wish. ZION PUBLICATIONS will not maintain copyright over the modified photographs, nor take any responsibility or claim on those modifications to the photographs. Modifications are done at the client's sole discretion.
     
  2. Websites
    Websites that run from a database may have certain contents on their website changed/modified by the CLIENT, or third party, through the Admin Panel on the website. ZION PUBLICATIONS will not be held responsibile for these changes/modifications made by the CLIENT, or third party.
    ZION PUBLICATIONS cannot and does not guarantee or warrant that files available for downloading through the CLIENT’S website will be free of infection or viruses, worms, Trojan horses or other code that may manifest contaminating or destructive properties. The CLIENT is responsible for the safety of the downloads that the CLIENT supplies.
    ZION PUBLICATIOINS is not liable for any loss or damage of any sort as the result of any such dealings or as the result of the presence of merchants, advertisers, or users on the site.
    ZION PUBLICATIOINS does not operate or control in any respect any information, products or services on such third-party websites. The CLIENT assumes sole responsibility for use of third-party links and pointers and disclaimers set forth herein are equally applicable to such third party sites.
     
  3. Web Hosting & Domains
    In the case of web hosting and domain name registrations, ZION PUBLICATIONS outsources these services. In the unlikely event that there will be a problem with the hosting server, ZION PUBLICATIONS will not be liable for any loss arising, (whether any incidental, consequential, or indirect loss, damages including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) from the server. The website hosting is provided by a separate organization and ZION PUBLICATIONS does not have any control over that organization.

  4. Email branding & Newsletters
    ZION PUBLICATIONS cannot and does not guarantee or warrant that the information and files sent/emailed from the CLIENT or PERSON(S) using this email branding or email newsltters will be free of infection or viruses, worms, Trojan horses or other code that may manifest contaminating or destructive properties. The CLIENT is responsible for the safety of the information and files that are sent/emailed.
     
  5. Printing, Signage & Promotional/Corporate Gifts & Items
    Once the CLIENT has signified his/her approval on a project, all liability for errors, changes, or alterations, whether the original fault of the CLIENT or ZION PUBLICATIONS, shall become the sole responsibility of the CLIENT. This signature of approval will be accepted and assumed either in writing, email, or through the final payment from the CLIENT.
    ZION PUBLICATIONS shall not be liable for any reprint/manufacturing costs or damages of any kind resulting from such an error. Charges for alterations or changes made after CLIENT approval shall be made at the discretion of ZION PUBLICATIONS, and the CLIENT shall be liable for any changes if imposed. It is the CLIENT’S responsibility to check all copy.

  6. Online Shopping
    ZION PUBLICATIONS will not be held responsible for any and all purchases made with the AUTHOR'S publications listed on the ZION PUBLICATIONS website. These purchases will be done directly between the AUTHOR and the BUYER. Sole responsibility will lie with the AUTHOR of the respective published item.
    ZION PUBLICATIONS will not be held responsible for other items purchased through or from the ZION PUBLICATIONS website, as these purchases will be made through other merchant websites. Sole responsibility will lie with the merchant website.
      
  7. Illegal Use of Images & Information
    Designs and publications are done so at the exclusive direction of and based on information provided by each individual CLIENT. The sole and entire responsibility for that same information rests with each individual CLIENT.
    Copyright to the design of other items such as logos, photographs or literature supplied by the CLIENT will remain with the owner of those items, i.e. the designer or the CLIENT. However, by submitting those items to ZION PUBLICATIONS, ZION PUBLICATIONS assumes they have permission to use those items on the CLIENT’S design without infringing any intellectual property rights by using them. ZION PUBLICATIONS will not be liable for breach of intellectual property rights or using items supplied by the CLIENT.
    ZION PUBLICATIONS produces designs to the specification of the CLIENT’S requirements. If that design infringes any intellectual property right belonging to another person, ZION PUBLICATIONS will not be liable for actions or claims arising from that infringement.
    Refunds will not be given for any job if any part of the design is not usable due to copyright infringement.
#6. Payment, Fees & Cancellations
  1. ZION PUBLICATIONS offers quotes free of charge.
     
  2. Deposits and final payments on invoices and statements are non-refundable.
     
  3. Payment will be required as follows:
     
    1. Graphic Design, Digital Publications, 3D Models, Caricatures & All Other Designs
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance. These designs will not be started until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required once the design has been completed and also before the design is released for printing or released to the CLIENT. The CLIENT or printer shall receive these photographs on 1 disk. Additional disks shall be charged for.
      If the design process has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design process has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.

    2. Book Publishing
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance for the cover design and typesetting/page layout. These will not be started until ZION PUBLICATIONS receives the deposit. The remainder of the balance is required once the cover design and typesetting/page layout have been completed and also before this finished publication is released for printing or released to the CLIENT. The CLIENT or PRINTER shall receive this finished publication on 1 disk. Additional disks shall be charged for.
      Grammar is quoted for separately. A 50% deposit of the total quoted balance for this is required before commencement. The remainder of the balance is required upon completion and before the corrected manuscript is released for typesetting/page layout, or to the CLIENT or to the printers.
      ISBN numbers and/or barcodes, if ordered seperately, require full payment before the barcode is created and/or the ISBN number is issued.
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance for printing publications. Printing will not begin until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required several days before the printing has been completed. Printed materials will not be released until the balance has been paid.
      If the design or printing has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design or printing has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.
       
    3. Website Designs
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance. These designs will not be started until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required once the website design has been completed and before official launch onto the internet. Websites will not be made live, and other relevant information such as admin details, will not be released, until the CLIENT has made the final payment.
      In the case of additions/changes to existing websites, ZION PUBLICATIONS will allow the CLIENT a maximum of 3 days in which to make payment on the invoice. This 3 day period starts when the invoice has been submitted to the CLIENT for final payment. If the CLIENT fails to make this payment, ZION PUBLICATIONS will suspend/remove those pages/designs or revert the website back to its original pages/design, until payment has been received.
      If the design has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.

    4. Web Hosting & Domains
      ZION PUBLICATIONS requires full payment of the total quoted balance for web hosting and/or domain names before registration. Registrations will not be done until full payment has been made.
      If the CLIENT cancels this registration within 30 days after payment, 50% of the total quoted balance (excluding the set-up fee) will be refunded. Thereafter the CLIENT will not receive any refunds whatsoever.

    5. Email Branding
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance for the email design. These designs will not be started until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required once the design has been completed and also before the design is released to the CLIENT or for encoding to the CLIENT'S email address.
      ZION PUBLICATIONS requires full payment before the email design is sent for encoding to the CLIENT'S email address. The design will not be sent for encoding until this payment has been received.
      If the design or encoding has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design or encoding has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.

    6. Email Newsletters
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance for the newsletter design. These designs will not be started until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required once the design has been completed and also before the design is released to the CLIENT or for encoding into an email newsletter.
      ZION PUBLICATIONS requires full payment before the newsletter design is sent for encoding into an email newsletter. The design will not be sent for encoding until this payment has been received.
      If the design or encoding has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design or encoding has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.
       
    7. Photography
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance. Photography/photo shoots will not be started until ZION PUBLICATIONS receives this deposit. All photographs are modified/touched-up after they have been taken. The remainder of the balance is required once these modifications have been done and before release of photographs to CLIENT. The CLIENT shall receive these photographs on 1 disk. Additional disks shall be charged for.
      In the event of a cancelled photograph shoot, which has not already taken place, the CLIENT is not liable for any fee. The deposit, however, is non-refundable. But if the photographs have already been taken, the CLIENT is still liable for the full balance on the invoice/statement.

    8. Event Designs
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance. Event designs will not begin until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required once these designs have been completed. These designs will not be released until the balance has been paid.
      If the design process has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design process has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.

    9. Signage
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance for the design. These designs will not be started until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required once the design has been completed and also before the design is released for printing or released to the CLIENT. The CLIENT or PRINTER shall receive these photographs on 1 disk. Additional disks shall be charged for.
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance for any and all types of signage. Signage will not begin until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required several days before the signage has been completed. Signage will not be released until the balance has been paid.
      If the design or signage production has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the design or signage production has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.

    10. Promotional/Corporate Gifts & Items
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance. Manufacturing of these items will not begin until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required several days before the manufacturing has been completed. These gifts/items will not be released until the balance has been paid.
      If the manufacturing of these items has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the manufacturing of these items has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.
       
    11. Printing
      ZION PUBLICATIONS requires a 50% deposit of the total quoted balance. Printing will not begin until ZION PUBLICATIONS receives this deposit. The remainder of the balance is required several days before the printing has been completed. Printed materials will not be released until the balance has been paid.
      If the printing has not already begun, and the CLIENT cancels, the CLIENT is not liable to pay any additional fees. The deposit is, however, non-refundable. If the printing has already begun or completed, and the CLIENT cancels, the CLIENT is still liable for the full balance on the invoice/statement.

    12. Online Shopping
      PERSON(S) buying published items from the AUTHOR'S listed on the ZION PUBLICATIONS website will deal directly with the AUTHOR(S) of such published items. The terms and conditions therefore lie with the AUTHOR of that published item.
      Other items purchased through or from the ZION PUBLICATIONS website will be done in accordance with the respective terms and conditions from the merchant websites used. No refunds will be given by ZION PUBLICATIONS on items purchased through these merchants. This issue lies between the CLIENT and the merchant.
       
    13. Additions to Quotes
      If the CLIENT makes additions to the quotes submitted by ZION PUBLICATIONS, after the initial deposit has been made by the CLIENT, the CLIENT shall be required to pay an additional fee of the total quoted balance to secure the job. No additions will be done unless this fee is paid.

    14. Delayed Designs
      CLIENTS are required to submit all relevant information and/or images within 7 days after the initial deposit is made by the CLIENT. If the CLIENT delays submitting this information and/or images, they shall be required to pay an additional 25% of the quoted balance on the invoice to secure the job. No additions/changes will be done unless this fee is paid. Failure to do so will deem the design as 'Cancelled'.
      CLIENTS who delay in submitting their feedback on jobs done by ZION PUBLICATIONS by more than 5 working day(s) shall be required to pay an additional 25% of the quoted balance on the invoice to secure the job. No additions/changes will be done unless this fee is paid. Failure to do so will deem the design as 'Cancelled'.
      All jobs done by ZION PUBLICATIONS are given a specific time-frame in which they will be completed. CLIENTS who delay this time-frame by more than 2 weeks,       shall be required to pay an additional fee to secure the job. No additions/changes will be done unless this fee is paid. Failure to do so will deem the design as 'Cancelled'.

    15. Multiple Chosen Designs
       ZION PUBLICATIONS submits several design concepts to the CLIENT to choose and work with. Only one of these design concepts may be chosen to work with to reach the final design. Changes and alterations may only be made to the one chosen design concept as specified by the CLIENT.
      If a CLIENT would like to make changes to additional designs, an additional fee will apply.
      If a CLIENT would like to use more than just one design concept, the CLIENT will be billed for each additional design concept used.

  4. Final payment of the total balance on the invoice/statement is to be made, by the CLIENT, within 7 days of the date on the invoice. After 30 days of the invoice/statement not being finalized, the designs/websites will be suspended and penalty fees shall be payable, by the CLIENT, on overdue accounts at the rate of 5% per overdue month, of the total balance.

  5. ZION PUBLICATIONS reserves the right to cancel/suspend the design and/or print process at any time for any reason. If the CLIENT has already made a deposit, the CLIENT will receive the money back in full.

  6. ZION PUBLICATIONS reserves the right to use the same design, website, photograph or publication from a previous CLIENT, if the design has been cancelled/suspended or the CLIENT has not paid the full fee.
#8. Requirements
  1. All information provided by the CLIENT should be supplied in an understandable legible format, either by email, or in .doc, .txt, or .ppt file. If unsure, please contact us.
     
  2. All logos, photos, design elements, and other images must be submitted in a standard acceptable format (.psd .ai .gif .jpg .tiff and .bmp) and be of high quality. If unsure, please contact us. The resulting quality of the design, publication and/or website may be restricted by the quality of the submitted items.

  3. All information and/or images should be supplied, by the CLIENT, to ZION PUBLICATIONS within 7 days after the deposit has been paid. Failure to do so will result in additional fees to secure the job.
